The fourth amendment itself has no loopholes but there are some instances where the fourth amendment does not apply. For example, if you are driving down the road and get pulled over and the cop smells marijuana in your car, the cop has the right to search your car because there is probable cause that you are breaking the law.
Under FISA, an act passed in 1978, there are some exceptions made for cases that involve intelligence gathering agencies (like the CIA or NSA). This act was amended in 2001 by the Patriot Act. I will post a link to wikipedia where it talks about this act, its history, use, and Constitutionality.

People have an inalienable right to their property, thus the government cannot search or seize property. Even if the 4th Amendment has a loophole, natural law dictates that government still cannot invade somebody's property.
It's illegal and immoral either way.

The loopholes aren't in the 4th amendment they are in newer laws that seem to over ride the 4th amendment. The Patriots Act is one of them

King George does not recognize the law of the land, he believes he is above it. Long live the king. Over 200 years of making laws and amending amendments has led to a Dictatorship that the American people believe they elect to represent them. Well if your in the Kings court you will be represented, shall we say companies like Dick Cheney's Halliburton.

Interpreting the Constitution is like interpreting the Bible or reading tea leaves. You can make it say anything.
The Fourth Amendment applies to "the people." Arguably that means us, not them. As long as the terrorist is one of them, anything goes. Also if one of us is a terrorist we can excommunicate her and make her one of them.
