The thing that sucks here is that if your landlord finds out he's living there without signing onto the lease, he could kick everyone out, including you. Telling your landlord about it yourself could be good and bad. He could turn it around on you and kick you all out. Or he could remove you from the lease, but you would have to get a roommate release, meaning, your roommate would have to agree with letting you out of the lease since you signed it together. You can't just up and move before a 30 day notice without bringing it to someone's attention. That will get YOU in trouble, not her.

If you wish, you may be able to get your landlord's help in getting rid of this guy. I'm assuming both you and your roommate signed the lease, and most leases have a provision that says no one else can move in without the written consent of the landlord. If this is the case, and you have a good relationship with your landlord, talk to him/her and see if he/she will help you get rid of the boyfriend. That way you don't have to look like the bad one -- you just say the landlord found out somehow and now you're facing eviction if you don't straighten it out. But to answer your question: If your name is on the lease you are bound by the terms of the lease, which means you technically can't move out until the lease expires.

has he actually moved in or does he just stay there more than 3 nights a week? when he's there do they violate your space? or do you just not want to live with a guy in the house. if that's the case tell you roommate that you want to move because of her BF. if she's OK with it just tell your landlord that you are moving out and another person is taking over your spot it should be pretty simple. they all you have to do is get your roommate and her BF to help you move since they disrupted your living arrangements

Unless you have a contract with your roommate, or your roommate is also your landlord, there's no breach of contract between you and your roommate.

You have to provide the 30 day notice to your landlord, not to your roommate.

If you are on the lease, you should have the landlord take you off or you will still be liable for anything that they do to the property.

Hey, listen, I only heard htis, but apparently in some states it's legal for each tenant on the lease to have one permanent guest.
You'd need to renegotiate, if that's true in your state!
