I have downloaded 1964 which allows you to play N64 games on the pc. I just want to know if it is legal though before downloading games (roms) to play on the pc.

Yes. Will NOA (Nintendo of America) hunt you down? No. No one actually cares, as long as no one else is making money. Nintendo just likes to be all grumpy about it.

The above answerer is correct. I read on nintendo's website that after a game is created, it has a copyright on it for up to 75 years after production. This is what they had to say: Isn't it Okay to Download Nintendo ROMs for Games that are No Longer Distributed in the Stores or Commercially Exploited? Aren't They Considered "Public Domain"? No, the current availability of a game in stores is irrelevant as to its copyright status. Copyrights do not enter the public domain just because they are no longer commercially exploited or widely available. Therefore, the copyrights of games are valid even if the games are not found on store shelves, and using, copying and/or distributing those games is a copyright infringement. Haven't the Copyrights for Old Games Expired? U.S. copyright laws state that copyrights owned by corporations are valid for 75 years from the date of first publication. Because video games have been around for less than three decades, the copyrights of all video games will not expire for many decades to come.

With ROM's, it is illegal to download one unless you own the specific original game, if you don't, you can still download it but are only allowed to keep it for 24 hours for 'trial purposes'

YES IT IS, REGARDLESS OF ANY SITUATION. Although I have heard rumors that it is legal if you download directly from your own cartridge and use it for your own personal use, but I wouldn't do it. Just buy the real game.

However, non-commercial ROMs aren't illegal at all.
