I have a lot that i'm selling,I have a buyer and I want to close.The problem is I have to have a "Home Owners Association disclosure
Packet" and proof the dues are paid,but repeated attempts to contact the Assocation have failed.How can i force them to reply so i can close?I mailed them a check for the packet two weeks ago and i haven't heard anything from them.Can they refuse to reply therefore preventing me from ever closing?

This is common with HOA's.
These groups usually have regular meetings that are open to all the members of the association. They have a President, VP, Secretary and Treasurer all appointed by the members. When you pay the dues in goes into a trust account, the manager handles it, but the governing body decideds how your money is to be spend. Like improvements and such. All should go to a Vote in front of the membership.

You should have a direct number to the association in your paperwork when you moved in. Otherwise it should be posted on site. The memership Board must live or own property in this sub-division. Therefore, you can literally go to their home when you search for their names and addresses. Any Real Estate Agent can pull up this information for you, explain why you want it.

The problem with HOA's is that they can hold you back from selling a home or lot in the division is the people buying are not approved by them. They generally look for people who they know will pay the dues and abide by the rules. If I was you I would be nice and polite in rectifying this problem. You are at their mercy.
Many people dont know that buying into a HOA hold them to different rules outside local rules and ordinaces.
HOA's can become tyrants, power hungry, and controlling. It all depends who is in charge. I have seen people be on vacation and miss one or two of their payments to the Association and have them come in and attempt to attach their homes so they can sell them off and pay the fees. This can happen.

Find the President and go to their home with your paperwork. Tell him your plan and get his OK.

Your assertion of the "data" lacks credibility. Why would the HOA insist you have cats in case you do no longer? Any habit problems with the neighbor is a separate situation. HOAs are inner maximum contractual arrangements - in case you think of the HOA is violating that is component of the settlement, you will could sue.

Sounds like you have a great association. You gotta get in the car and show up at their office and stay until you get what you need. I assume you don't have a realtor, to pawn that job off on?

It shouldn't be so hard, just stay on them like stink on poo.

Send a certified letter with a return receipt request.
Also, photocopy the cancelled check and include that.

My HOA is just as pathetic as yours. You have to keep calling them every day until they get tired of you. Go to their office to pick it up or give them a fax number if you have to.
