My brother has been in prison for 11 years, he had a daughter that was born just before he was sentenced. He has tried to maintain a relationship with his daughter, my mother and I taking her to visit as much as possible. Her mother decided a couple years ago that she did not want them to have any more contact with each other, after her and my brother got into an argument on the phone. Since then, my niece has only talked to her father on the phone once or twice and had no more visits with him. Now I have learned that my niece's mother has filed papers in South Dakota to have my brother's parental rights terminated, presumably so my niece can be adopted by her step-father. My brother is serving a 16 year sentence for drug dealing, the mother of his daughter also did 2 years for accessory to drug dealing while she was pregnant. Does she have any grounds to deny him visitiation or terminate his rights to his daughter?

He has been paying child support throughout his incarceration as well.

This is too lengthy to repeat here........but read it....yes, it is possible, however since the conviction was for drug distribution it may be possible to block the termination......usually the offenses that aid in obtaining termination of rights are assaults, murders and the like.

If both parents accused of Drugs, how can you see them bringing up a child? To be like them?
I certainly go for the termination of both parent's parental rights in this case. Let's just hope the court be convinced that the new guardian has better chance bringing up the child in more clean environment.

Sorry, but I don't think a prisoner should have any rights at all, except that he not be abused or ill-treated while in prison. You commit the crime and should serve the time. If you ever knew the grief that some prisoners put some families through, because of their actions. mark you, some are innocent, but that is another matter altogether.

She'd have to prove Why she wants to do this....any Judge wouldn't let it happen without both parties present.
