Mother is a naturalized us citizen traveling back to the country where her son was born (Ukraine) and she was divorced. Both her and her son are US citizens and his father lives in Ukraine and pays alimony. The mother is remarried to a US citizen living in the US. When traveling out of the US does she need the child's father's permission. The child will be 12 years old when they travel.

Your divorce and/or child support decree should cover this topic. However, if it does not, the rules can differ by state where it was decreed. In some cases, you cannot take the child out of the state, much less the country, without the knowledge of the other parent. Your decree may or may not say this. I would check with your attorney. It also might allow temporary travel (such as a vacation) as long as a round trip ticket is purchased at the outset. Just bear in mind that whether he has paid support or not or whether you consider him as having abandoned your son, he still is the child's father legally. You do not automatically inherit the right to commit another crime by removing the child against what might be court orders. The court won't care if he paid support. They will prosecute him for the support issue and you for violating the order by removing the child from the country. You could end up paying for it if he finds out later on and reports that to the court. However, as I said, in most cases, you can make SHORT-TERM, TEMPORARY trips with no problems. Best answer is still ASK YOUR ATTORNEY particularly because of differing laws of states and differing agreements of child custody.

Why would the ex-husband be paying alimony if the wife is remarried? Now child support is a different thing - he will always be the child's father.

Whether or not she needs the child's father's permission would probably depend upon what the court papers say regarding custody of the child.

ASK AN INTERNATIONAL ATTORNEY!
Another option would be to talk to somebody from the closest Ukrainian Consulate Office.

This is especially important due to the fact that the divorce took place IN Ukraine -- their divorce laws may be different than ours!

You don't know what Ukrainian laws might apply once you set foot back in that country.

It sounds like both the father and child (dual citizenship?) are Ukrainian citizens so you might be in for a nasty surprise if you are not careful!

I am a travel agent and I would definatly recommend having a notorized letter from the father stating that it is okay for the child to leave the US. Even though they are divoirced and if he is still in the childs life as much as he can be living in Ukraine he still has the right to say no I dont want him going. Hope this helps!

I think this is an interesting question but I dont think she does. The father lives in another jurisdiction and I guess if it doesnt say anything on her custody agreement about international travel she would not have to. If she were moving then she would have to but not to just travel. If the father was in the US she would have to.

Yes! She will need a note from her X saying it's OK for the child to travel with the mother. It needs to be notarized!
