You have to MAIL you tax return and deal with the IRD directly. Since your kids are PHYSICALLY living with you, theh he would need a form 8283 to file legally.

As soon as you file your taxes and try to claim your kids, you will know because that will tell you that someone already filed those SSN's. You have to be quick on the punch because if he have already done his, then you do not have much recourse. You could take him to court so you can get a judgment so he will have to give you some kids to file, but that is about all you can do. Whoever has custody and file first will get the exemption.

Who is the "custodial" parent? According to my tax people the following is new for 2006:
Non-custodial parents BEWARE
New for 2006, for parents who do not have "custody" of a dependent, (physical presence in your home more than 50% of the year), the non-custodial parent must now have a signed release from the custodial parent. IRS is no longer accepting any agreements that were made during the divorce proceedings and/or detailed in the divorce decree.

Get his SSN and call the IRS and tell them your problem. If what you say is true, you are not only entitled to the back taxes but he could go to jail. That's tax fraud clear and simple. This kind of stuff really frosts my cookies! I think we in this country need to make deadbeat fathers accountable. If they make kids they should be made to support them. If they won't they should go to jail.

My wife did the same with me........she claimed the kids and so did I and when the tax people did their audit on your returns. they found out I had the kids and she was paying me nothing.
So claim them also and let the tax people fix it.

if you go ahead and file and he has used the kids numbers the IRS will let you know. they will then work with you to get it straightened out.

try to claim your kids and if he did, yours will be rejected, then you can tell irs the whole story. do your tax early.
