No, none of those answers are correct.
It was decided by the electoral college. The kerfuffle in Florida occurred when the Florida Supreme Court decided to change the rules of the recount AFTER the election.
This was seen as a violation of both the Constitution, where it states that it is up to the state LEGISLATURES to determine the method of selecting the electors. Since state law already had a legal recount method established, the creation of a new one by the Florida Supreme Court seems a violation of Constitutional law, does it not?
Secondly, when the manual recount was allowed, there was no set of standards how to count votes to determine the elusive and ill-defined "intent of the voter". On the same type of ballots, each precinct was using a different standard. This was considered by the USSC and the minority of the FLSC (read the minority opinions on 1st source, starting at page 40) to be a gross violation of the Equal Protection Clause, and the USSC ordered the farcicle recount stopped.
When the newspapers did a formal recount, they found that Bush, indeed, did win if the recounts requested by Gore and the Florida supreme court had been completed. See 2nd source. Now it does say that it may have not been so if there had been a full statewide recount - but that was not what the USSC stopped. The recount stopped by the USSC still would have resulted in a Bush victory.
So, educate yourselves on the truth of the matter, instead of spreading falsehoods based on irrational hatred of Bush.

Here we are, seven years later, and still so many people are uninformed on what happened in 2000. How about you take some time off from your blinding hate and do some research. You will find that the actions of the Supreme Court were correct and later recounts proved their decision would have been unnecessary.
For better or worse...worse in most of your opinions...Bush won the 2000 Presidential election. You may not agree with what happened, but it's said and done. Time to move on.

Yes the Supreme court. Though after John McCain beat Bush in the New hampshire primarary the "stunned" Republican lobbyist brought out the big money guns in the next few states and blanketed the airways with the lie that John McCain fathered a black child.
Imagine if McCain won. He being a Moderate would have beat Gore in a landslidein 2000 and there would have been no recount. The Democrats would have lost half of there ammuniition in 2004. Kerry never could of ran and won against a Vietnam Veteran such as McCain.

They did not decide the election, they ruled on an appeal from the Florida Supreme Court.
By the way, in case of doubt about the outcome, the great New York Times recounted the ballots and came to the conclusion that Bush DID win, and they hate Bush

The Supreme Court denied Al Gore the right which he was due to get the FL recount for all counties. So Katherine Harris certified the vote count in favor of Bush thus giving him the electoral votes needed to win.
Ironic considering the SOB now lumps them with the " activist" judges who helped him get the job in the first place
