I'm thinking about married women. Surely a woman only assumes their husbands name and doesn't actually change their name legally.Therefore if they divorce they revert to their maiden name I would think. Is this true?

No they legally change their name, if they divorce and want their maiden name back they have to change their name by depol.

A woman can legally use her husbands last name or her maiden name. After divorce, she can stay with the last name of her husband or request in the divorce documents, that her maiden name be restored legally. Marriage does change the last name legally.

Your legal name is whatever name you have at the time. For example, in America, the name a woman is born with is her maiden name. Once she marries, and only if she chooses to, she may drop her maiden name and add her husbands or she may incorportate both names with a hyphen. Some women do change their names even if they are not married to something shorter, or something more to their liking. Once a woman is divorced, she does not have to drop her ex husbands name. For example, if children were born into the marriage, she may decide to keep her exes name to avoid causing more confusion for the children or upsetting them. It is also less costly to keep the name you have so you do not have to get new social security cards, drivers license, bank account and new checks and credit cards, etc.

If a woman assumes her husband's name upon getting married, it IS a legal name change.

any woman can choose either to take the husbands name and revert on divorce. They are not in any way obliged to do it at marriage though !

When a man and woman marry they exchange vows to love cherish (and sometimes to obey) but they don't swear to adopt the other's name. This is purely convention. The man can just as easily adopt his wife's name or they could choose to use both names. If you believe in divorce you can either revert back to a former name or continue the adopted name. Convention.

When I divorced I changed my name by deed poll which cost me £50 but if I had wanted to go back to my maiden name it wouldn't have cost me a penny and I wouldn't have had to do it through my solicitor so I guess your maiden name is always your 'legal' name. Mind you, I signed to say that I can't use my maiden name either anymore. My new name is now my only legal name.

Typically women do change their name legally at Marriage- but they do not have to. Some married women change their name socially but not legally. (they just start using their husband's last name). If they want their driver's licence and passports to reflect their married name they do have to change it legally.

First of all...this is a public site and I don't feel it is wise to share our legal names.

Second...When I married I legally took my husbands last name as my own. When I divorced, I legally changed my last name back to my maiden name for reason that I feel it is an honor to carry a man's name...for reasons of his behavior in marriage...I don't feel he deserves the honor of my expressing his name out there...so I took my own name back.

His kids carry his last name...that is fine. I legally took my former name back as was my right. Reason shared to my kids was that many women will take their own names back after divorce but I honor that they have his name. They were fine with that explanation.

you are dead right, only if she actually changed it by deed poll would she need any legalities to change it back, btw u can call yourself anything u want, as long as its not for fraudulent purposes
