What kind of divorce will she have to file for a guy who hasnt been back to the us for over 7 years. She also has no address info on him. He is definately gone though. He ripped off a whole lot of people including my girlfriend, and left the country. What does she need to do before we can get married??

Your girlfriend is still legally married to him until she files for divorce. She can still get divorced if he is no where to be found, but it depends on what state you live in, some states may differ.
She would have to file herself, otherwise, seek legal advice from an attorney.

After 7 years, she can file divorce papers citing "alienation of affection" or "desertion". Seeing as she hasn't seen him in 7 years, I think the "divorce" would be final in about six months. If he deserted her and he's in another country than he can't be served the papers, he won't be able to respond, so the divorce will be uncontested. Contact an attorney ASAP. The ball's definitely in her court!.

this happened to one of my friends.. He put an ad in the local newspaper for her return for 3 months, filed for divorce lawyers took care of that and got re married after 2 years.

She needs to file for divorce. She will have to serve notice by publication. She can use abandonment of the marriage as grounds.
