To add, can a Canadian citizen that is a member of the American Bar Association and practicing in the US (but is not a citizen) judge over small claims court even though they are not a citizen? Plus, what are the other requirements? Please provide references.

The qualifications for various positions in the New York State judiciary vary by position. Even saying small claims court isn't sufficient to generate an answer - there are small claims judges who are elected Civil Court judges or town judges...and some who are appointed.
