I would like to know if a couple files jointly in the state of Georgia and one of the parties doesn't claim income received for a certain year and receives notification from the IRS, who is responsible for paying the money owed? Is it the person that files first, the person that didn't claim the money received or the primary person listed on the tax return?

You both signed the return jointly, you are both responsible for any debt owed on that joint return

both! That's why Al Capone's wife filed as married separate. She knew her husband was a crook and didn't want to get mixed up in his tax evasion.

When you sign a joint return you are stating that the return is accurate.

The person responsible is the person whose income it is. The income will have been reported to the IRS with a social security number...that person owes.

When you file the taxes this year - include form 8332 - Injured Spouse form. This will prevent them withholding any refund that is attributed to the innocent spouse from being taken to cover the tax on the undeclared prior year's income.

On a joint federal return, both parties are liable for anything left off or stated incorrectly.
