I am adoptinga 14 year old child, when I marry her brother. He has legal custody of her right now, but she loves me as a mother. We just found out that they are both adopted. He questions weather teh adoption was even legal, alot of their childhood is questionable. IF wed ig into this and find teh birth parents, can the birth parents take her from us?

A fourteen year old girl would be given a say in any custody case.

A juvenile court judge would give her a say in who she wants to live with.

Find a good family law attorney.

Good luck.

I had a similar type of case. My brother is 24 and I am 15 we have the same dad but differnt moms when my brothers mom gave birth to him she did not want my father in his life so she tried very hard to keep my dad away from his son. My brothers mother worked as a maid and nanny for an ammbasador and his wife ( very rich.) After awile the ammbassador and his wife grew to love my brother very much they offerd his mother to adopt him and that they would pay for everything he may ever want or need and that she could live in thier house with her son untill he graduated from highschool at the time she was having a hard time paying the bills and taking care of my brother so she aggread. At the age of 16 my brother told his mother that if she wouldn't tell him who his father was he would drop out of school so she told him. But by the time he was able to vist and meet my dad he was over 18 and was not able to change his parents even though he wanted to.

So if you want to adopt her and keep her adopted it only takes 3 things.

1. You are wiling to adopt her
2. She wants you to be her parent more then here legal parents.
3. Make sure the whole custody battle is done before she turns 18 because even if its one day after the court will not change there mind all adoption work has to be done before she is 18.

- A good lawyer wouldn't hurt either.

I really do not know. I think it all depends on who adopted her first. If they did they may have the rights to her but i am not exactly sure. You should ask your adoption agency about this and see what they have to say. They will be able to tell you if the adoption was even legal or not. I wish you the best.
