My children left home, and they settled on their own. I have three.
The two oldest are featherheads. They got houses for themselves, and these houses, very bad, the slightest breath was enough to destroy them, and they were not even insured. So, they moved in with the third one, and his house is very nice, stone structure.
But now they have trouble with Mr B. B. Wolf, a tax collector. They did not open the door to him, so he tried to enter through the
chimney, and was badly hurt.
Now they are asking me to step in and pay Mr B.B. Wolf's hospital fees.
Should I help them?

Mrs. Pig,
The first issue is your possible liability for Mr. Wolf's hospital fees incurred after his injury at your youngest little pig's house.
Rule: There is no duty to pay for damages resulting from the negligent torts of an offspring, child or adult.
Analysis: Your children are adults and (were) homeowners, in their own right. They incur liability in their own right. In the absence of a statute obligating you to pay for your offspring's torts, you have no legal duty.
Conclusion: You have no legal duty to pay for Mr. Wolf's injuries.
The second issue is your two elder little pigs' possible liability for Mr. Wolf's injuries at your youngest little pig's house.
Rule: A guest in another's home is a licensee, and owes no duty to another person who is injured in that home.
Analysis: Your two elder little pigs were licensees in the home of your youngest. As such, they were guests. From the fact pattern presented, they were not added to the deed. Any duty of care to Mr. Wolf would be solely borne by the homeowner, your youngest little pig.
Conclusion: Your two elder little pigs have no duty to pay for Mr. Wolf's hospital bills.
The third issue is your youngest little pig's possible liability for Mr. Wolf's injuries at your son's home.
Rule: A trespasser who is injured on the defendant's property cannot prevail in a suit under a theory of strict liability. The trespasser must prove that the property owner was negligent.
Analysis: Mr. Wolf, as a tax collector, most likely had no privilege to force entry into your youngest little pig's home in the course of his employment. Without a privilege to enter, a court would probably conclude that Mr. Wolf was in fact a trespasser.
Prosser's four elements of negligence are duty, breach of that duty, causation and damages. Because your youngest little pig had no duty to maintain his chimney in a manner which would afford safe passage to trespassers, the remaining three elements need not be addressed.
Conclusion: Your youngest little pig is not liable for Mr. Wolf's hospital costs.
Ultimate conclusion: No, nobody needs to pay.

well momma pig a couple questions.........
are the piglets irresponsible?
do you think the house will be blown away if you don't help?
if you don't help will the piglets, spouses, and offspring end up living under your roof leaving you wanting to hire a hit wolf to blow everything away???
if you choose to assist make it a loan (one that you know might take some doing to get back) and have them all sign some type of legal agreement that they will pay you back.
Good luck!!!

Advice....NO MAM!!!!!!!!!!!!!!!! DO NOT!!!!!
Example...I am in my thirties and my parents have NEVER helped me out financially...for they have never had the resources to do so...in fact, I help them!!!!! But because of this, I have worked and made my own money from a young child on up and I am more self reliant and resourceful...I also do not waste money..you raised your children, that was your part..now reward yourself for your efforts and allow them to be just what they are....adults!!!!!!

Two things to consider
one) there your kids (so yes)
two) they are adults they should be able to handle themsleves (so no)
I would just because they're your kids but once in a while you have to let them find their own solutions.

If you can afford it, help them. They are your kids. But if it will put you out on a limb, tell them, too bad. They got themselves into it, they can get themselves out of it.
