i worked for almost three hours and they say they wont adjust my time card and im just not getting paid, how is this legal? How can they have you work and then not pay you for it????

Okay, having been a supervisor in an environment where people used a time clock, I will first say that usually a company won't take such a rigid stance unless the problem is habitual. If you've had this problem before and it's not improving, then this may be their way of showing you how important it is to clock in.

But I also realize this may not be the case, so:

You don't say what kind of job you have: if you work in a call center, you may have to log in with a code on the phone which tracks your call handling statistics.

Or if you are logged into a computer, have your LAN services group show the correspondence date/time stamps that prove you were working.

Is there any other kind of time stamping mechanism where you work, or a closed-circuit television or anything that will chronicle that you were there and working?

If not, this may be a hard lesson learned well. I do wish you luck with this.

When you forget to punch the clock - your money they will dock. It doesn't seem fair until you are the employer and your employees don't follow rules (like punching the clock) and you have to rely on that worker's honesty for when they started back to work.

Your boss doesn't know you, and cant risk paying anyone for time they did not work. Keep in mind it is standard procedure many places to dock a worker's pay for not being at work on time, not punching the clock and not following the rules.

Its up to you to follow the rules and be responsible. The more responsible you are, the more valuable employee you become. The more valuable and employee you become the more your paycheck becomes because eventually you can ask for raises,

Its punishment - but a better punishment that getting fired. Much better than getting fired.

Think about it: if you don't clock in, there is no record of your having been there. (The camera is not in any way connected to the payroll system.) I worked in a college, believe it or not, that required staff to clock in with a hand scanner. If you forgot, or if the scanner didn't work, which happened often, you could fill out a time adjustment sheet. The payroll person then had to input your hours. If your hours weren't in the system, they could not issue a check for those hours. In the end, I doubt very much it is legal not to pay someone for hours she actually worked.

If they know you are working, they are required to pay you, clocked in or not. Contact your state's labor board if they refuse.

Does this mean if you forgot to clock out at the end of the day, they would pay you for working all night?

That's breaking a labor law!! I am a manager and each week have to make adjustments for missed punches. I'd first go to your HR dept. If that still doesn't resolve this issue then go directly to your State Labor Dept. When you go to HR get the names of the peers that witnessed you working. Your Manager needs get off of her/his high horse and power trip.

Request to see the time reports/time card. They need to back up their claim if they are not giong to pay you. If you think you are violation, call your states labor board and file a complaint. There should be information posted somewhere in the building that gives you contact numbers.

It is against the law in all states to work without compensation. Your state has a labor board 800 number to call and report them. Or if you really want to push it get a lawyer.

...well ....don`t you have some co-workers to plea your case? I`d go up to the big boss with some witnesses...........i mean what else could you do ...and i hope this is your first time "forgetting"
