No, both of you can not claim the same dependent. You need to discuss this with his mother and find out if she is willing to allow you to claim him because you provided for him for more than half the year.

Whoever had custody of him for the majority of the year. If you claim the child and she contests it, you will have to be able to show that you had custody of the child for more than 6 months and provided for the majority of his expenses. This can be researched down do Days even HOURS that you had custody if the mother is willing to fight for the claim of the child on taxes.

Find out if she plans on claiming him, if you both claim him you will both get audited. Also, if she has claimed him every year in the past, you will get audited because he has changed residencies. If she claims him now, she will be in the wrong, he lives with you now. Talk to your accountant, he will know what paperwork you will need to claim your step son. I go through this with my son and his father, my son switches back and forth between homes, so I know.

Only one of you may claim him.. generally it is whoever had him the last part of the year, but if she had him longer then she may claim him. Best thing to do is to let her know that you intend to claim him and make sure that this is not an issue for her.

Yes, if you and your husband supported him. I am almost sure you can claim him for 2006 but to make sure, call IRS for more information. They usually have a toll-free number where you can reach them.

If you adopt them, or become their legal guardians.
If he actually is ur step son (i.e. marriage), then essentially you're taking responsibility for them.

i think either you and your husband, or the little boy's mom can claim him. because she took care of him half of the year and you took care of him the other half of the year.
