Why would the landlord sue to keep your deposit? He already has it. You'd have to sue to get it back, right?

If you left the residence in the condition you entered it in...you are legally entitled to your security deposit. If the landlord won't give it back...take them to landlord/tenant court. They'll have to PROVE why they kept it, and if they can't come up with anything valid, they have to give it back to you. They can't keep your deposit for normal wear and tear...things they would have to do to re-rent anyway, like painting, carpet cleaning, etc. If you damaged the residence beyond normal wear and tear, the landlord can keep what is REASONABLE to fix it. But again, they have to have SOLID proof of the damage.

Who knows! Landlords are weird. I'm just moving out of my first place too and it's been interesting. I know here there's a simple claims court that you can take them too and it depends if they have a reason to keep your deposit. Is the suite illegal? Because that happens a lot too where they arent actually allowed to have a basement suite (if thats what it is). If that's the case then you have a lot of power over them.

No. You're entitled to the deposit.

If the landlord wins, he gets it. If he loses, you get it.
