I have only been married for 10 months, I only got married thinking my husband was going to Iraq, He said I had to marry him in order to get my daughter on insurance. We have been seperated since sept. 2006. I am finding I have alot of problems filing taxes, getting things done. I guess I need to get legally seperated through the courts. I am 20 years old, not to sure how to go about doing that, until I get a divorce. I don't make alot of money, so I can't afford to get a lawyer, if I even need one. Is there any other way to do it. He was abusive towards me, was addicted to drugs, alcohol. He has got kicked out of the army since Nov. 2006 because of the drugs. I just want to be rid of him, how can I get the legal seperation without breaking my pockets. I want to get a divorce, but Like I said, I know that is expensive, and He already stated that he wouldn't sign the papers.

If i was you i would go talk to JAG about getting legally seperated. If you dont want to go through with a military attonery then go to a civilian one and ask them how much. I know that in NC you have to do it through a lawyer. I think that JAG will help you. Go to the ACS building at the base and ask thats what they are there for to help the families
Good Luck
Also contact his chapain and tell him that he said that he wasnt going to sign the papers.... Let it go up to his command and they will get something worked out...

You cannot get legally separated without him signing papers either. Plus legal separations must have certificates of legal advise with them which would require a lawyer.

I would suggest you contact your local legal aid society. They will often deal with family matters if there is a child involved.

If you can get a legal aid lawyer to handle your matter you can get a divorce without him signing. Your lawyer will just have to apply for a court order for same.

Also, try contacting your local law society or legal bar. They may have a list of names of lawyers who will do pro bono work or at least take a payment arrangement like monthly payments.

Also, he should be paying support for the child, so that may give you some extra money to pay a lawyer.

You need a divorce and not a legal separation. He doesn't have to sign the papers.
