me and a friend got an apartment and we both signed the lease, is there anyway i can move out if he stays and we have someone else to take my spot?

i am leaving because i am moving back home. im just not happy here.

Talk to your landlord. He/she will have to do a background check on the new person, and there will have to be a new lease with the new tenants signature on it.

Not speaking for your landlord, but there shouldn't be a problem

If the apartment manager will allow it, you could notify them in writing that you will be vacating the apartment but your co-tennant would like to continue the agreement with another party. They will have to screen the other person of course and a new contract will need to be drawn up. Some places don't do it at all, some do it after 3 or 6 months. Why are you leaving? If your leaving because of your job, many leases have an escape clause that allows you to give written notice of 30 days if you've been in the unit for a minimum amount of time like 3 months. They key is why your leaving and what your aparment management will allow.

That will be up to the landlord. If he/she lets you out then it's no problem. Most will let you out if you have another to take your place. They may have to sign a new lease for another 6 months/year, whatever it was.

first what does your lease say about sub letting, if it has a provision you will have to follow it, if silent then state statute usually encourages subletting, now the person who is moving in will have to meet all the same criteria you two had to meet to rent the apartment
