permanent staff are being made redundant at my workplace, yet nothing has been said about the temporary and agency workers. Surely they should be gotten rid of before permanent workers are!?

Hi,

This depends on the definition of "temp" and as you have stated 2 categories of temp and one of agency worker I believe that a temp could actually be a fixed term worker.

A fixed term worker is someone who has been employed through the company (i.e. is on the payroll directly from the company) and has an expected end date. In these circumstances those people are protected by The Fixed Term Employees (Prevention of Less Favourable Treatment) Regulations 2002 which ensures that they are treated in the same way as permanent employees and should also be considered for redundancy although not necessarily selected for redundancy over a perm. member of staff.

Agency workers are a different matter as they are not employed by the company but by a third party, it is therefore not necessary for them to be disengaged before redundancies are made as they will not form part of the pool of people being considered for redundancy.

I would say that if the agency workers are doing the same job as those being made redundant the company should be terminating their arrangement with the agency otherwise they could be affecting their arguement that the need for the people they are making redundant is diminishing!

One other thing you should know is that if there are more than 20 people being made redundant you should be given 30 days consultation prior to any redundancies being made and if there are more than 100 people affected there should be 90 days consultation.

The tide has been slowly shifting there is now no such thing has a permanent job.Eventually all jobs will be staffed by agency & temp workers.My husband has been a contractor for 15 years only because there is no permanent jobs in his line of work & he his a highly qualified Draughtsman.

Nope - the companies can offset the cost of temps against tax - so it's actually more efficient cost wise to keep them - wrong I know but that's the facts

They will almost certainly cut back on temp workers first.

Talk to your supervisor. There has to be someone who sign your time sheets. If you do lose your job, another one will come along.
