I had applied for a job at Microsoft 9 months ago and have gone through several telephone as well as face-to-face interviews. I was finally offered a job with package and which I accepted. I was told that the contract is being sent for my signature and was also provided a DHL Airwaybill number for tracking the contract. According to the correspondence with Microsoft I gave Microsoft Jan 1st as my joining date, which they approved. I provided my notice (1 month in advance as required by my contract with them) to leave my previous employer and by mid-December I had left my job, but there was no sign of the contract. The office I was suppose to join were told that I will be joining by the 1st of January. I even met the manager and discussed things that we will be doing in this position. Upon following up for two months they came back and said that they regret that they cannot hire me without any reason.

I am planning to sue as I have kept everything in writing as a proof.

First off your contract is really consistuted as an offer letter, which probably states that your employment is "terminable at will" which means that either you, may resign at any time, or Microsoft, barring any discrimination issues, can terminate you at any time. Companies put this term in offer letters for these exact situations to cover themselves. i.e if they find anything about you during a background check. If you received an actual contract saying this employment is binding, then you have a case, but not many empolyment terms have a binding contract.

That's terrible what they did to you. I wish you the best of luck and if I were you, I'd try and sue them. Get a good lawyer and sue for lost wages and all legal fees. You'll be my hero if you win. I hate Microsoft. GOOD LUCK

Yes, this would definitely be worth looking into. You have suffered a loss, and are entitled to be re-embursed for your lost wages and possible monetary damages.

that is severely messed up... I agree that they shouldn't be able to do this... but I don't know what to tell you.. I'm not a lawyer.. maybe talk to an attourney?
