Because the Government and Law is not here to enforce morality. Other "immoral acts" that are illegal are so because they cause severe harm to others and society. While I don't condone adultery, it is hardly something that severly affects society. The wronged person in a case of adultery can have their revenge and restitution by way of alimony in a family court setting.
Besides we don't have enough prisons or police officers to deal with murderers, rapists and theives, now you wanna put all the adulterers in prison too???
And it is illegal in some context or another in most places, just not enforced, like other silly laws like not eating ice cream on Sundays and stuff.

Because thankfully we live in a free society. Our govenment doesn't exist to legislate morality, nor IMHO should it. That is a sticky line. Although I believe in olden days it was illegal until people began taking the Constitution seriously. (Most of the time at least, but I digress).
Each individual, however, is accountable for their own choices in life, and my feeling is that sooner or later we all pay and are judged in some way for our actions, but by a far wiser judge than those here.

Actually, in the military, Adultery is a crime punishable under the uniform code of military justice. You can actually go to prison, believe it or not.

In my state Adultery is illegal. In the state of Michigan you can be arrested for it.

The fact that it is legal nowadays is the result of our permissive society. Face it, marriage should be considered a legal, binding contract. Any other contract that is broken has consequences. But because of our society, this one has few consequences and is allowed to be broken for the least of reasons.

it should be illegal if u have a legal document showing u are married and took a vow of fidelity .... adultry should be reason to break the marriage and the offender recieve nothing from it including money and any children ... it should be illegal in that sense ...
