Tom Petty stated on his website that 'if' they did indeed 'take a little bit' of his song for their inspiration then he would consider it flattering and not a matter for the courts. He went on to state that most all songs have something borrowed in them, including himself, and that the universe has more problems than one millionaire suing another millionaire over something that inspired them. There have been several sound-alike hits dating back into the 50's, but the burden of proof lies in where the music is generated. For example, George Harrison's "My Sweet Lord" in similar melodically to the soul single "He's So Fine" but Harrison proved he was unaware of the song as a reference when it was written in 1970. Sheryl Crow's "The Light In Your Eyes", by comparison, is a known tribute to George so she deliberately sounds like that "My Sweet Lord" guitar riff on the bridge, and she does not get sued for this reason.
Tom Petty's lawyers would have to find out if they have a case.

I heard that the song was inspired by the music of the Wu-Tang Clan. So, I don't think they were thinking of Tom Petty.

WOW. I JUST OPENED ITUNES TO LISTEN TO THEM AND YOUR RIGHT THEY SOUND ALMOST IDENTICAL JUST THE TEMPOS BEEN CHANGED A LITTLE. AND THE INTROS ARE SCARILY SIMILAR. BUT THE LYRICS HAVE THE SAME RING. THEY TALK ABOUT A GIRL AND IT SEEMS THEY LIST ALMOST THE SAME DETAILS ABOUT HER. TOM PETTY SHOULD SUE. I MEAN I LIKE THE RED HOT CHILI PEPPERS AND ALL BUT IM A MUCH BIGGER PETTY FAN. It's pretty similar, mainly because of the rhythm... But if the RHCPs hadn't known they were imitating it, it's not really fair! I know that, being a creative person, it's easy to imitate things you've heard/read/seen without realising it...
And I haven't heard any more about it...
