I was suspended at 4pm as my boss thought I lied to her, that night at 11pm she sent an email to the entire sales staff pin pointing one individual but without a name. Email as outline:"It has come to my attention that I have been secretly accused by a member of the sales department of having emails deleted from the company’s server. I apparently have this done on occasions where I want to contract previously sent memos I no longer wish to honor. Let it be known that I am extremely insulted by this accusation. I may very well forget items on occasion but to be accused of such a deceitful act both concerns and disgusts me. Let it be known that I do not have a need to lower myself to such levels. It has always amazed me to hear rumors, gossip or accusations coming from a source that is too sheepish to confront the recipient of such accusations face to face. I have always believed this sort of action to be the design of a an insecure person with the need to somehow dissipate their own

If everyone on that email knew or understood it to be you, regardless of whether or not you were named in the email you have a case for defamation IF the statements were false AND those statements cause damage/harm to your reputation.

However, if the statements are true, then this is a complete defense.

In looking at the above email. I don't necessarily see anything which is libelous in anyway since those statements could be considered mere opinion. However, if you think there is some merit, you should see an attorney.

There is no defamation of character in there. Unless you did actually accuse your boss of all that.... in which case you'd be the guilty party, but only if you tried to publish it in some way.

As for defamation of character, no, you weren't named any where in the email.

But you may be able to appeal the suspension.

Sorry I cant agree with you there isnt anything wrong with that email. Sefimation must contain untruths that hurt a person. What she wrote is her opinion and not untrue.

I would appeal to the boss above your boss. If there is no boss above your boss then look for another job as she really thinks you did this.
