For example, could Michael Jackson sue the Scary Movie makers?
Do the spoof makers have to pay a fee to the makers of the movies they are making fun of to 'use their film'? Like War of the Worlds in Scary Movie 4?

Spoof movies get as close as they can to the barrier of being sued. They can mimic and make references from other films without paying copyrights as they arent accually copying the film.

If a spoof was make purely on one film and was based to closely to it, then yes they could be sued, but as you cant really watch a spof and compare it to the real ones then they get away with it.

With regards to Michael Jackson and those sort of jokes, then then play very near illegal. For example a music video by Eninem was very closely based on Michael Jacksons court case and activities he was accused of. Michael Jacksons team failed in a court case again Eninem.

Spoof Movies work in the very grey area of illegal or legal.

That's all cleared long before the filming starts. And yes, permission is required for a lot of it.
Remember Back to the Future where Clint Eastwood's name was used? He gave his okay to do that. Just like George Lucas did with Mel Brook's spoof on Star Wars, Spaceballs.
