I Know that one of the tax rules is to file as a household but it is not working.Can an unemployed housewife file separate by herself in the same house.

you must have an income to file Income tax return, head of household.

You don't qualify for Head of Household, your married and have lived with your spouse the whole year. Head of Household is for single parents. (you can be married too, but there is a list of qualifications that most married people don't meet)

A spouse is never a dependent. They are considered equals on a MFJ return.

Edit - I had lunch today with a tax preparer w/ over 20 years of experience. She said if you do not trust your husband is reporting income appropriately that you can file Married filing separately (MFS) and file with zero income return. This is legal and a good cover you butt maneuver. However when he (your husband) finds out that you filed seperatly he may be quite cross with you, because many benifits to Married filing joint (MFJ) get taken way when people file seperate.

You are taking the "half his income is legally considered yours" statement in community property laws too literally. You can not file that as income, as it is paid technically to him.

And, you would lose all the advantages of filing jointly. So, it really would not make any sense.

Now, if you have a part time job, or some form of taxable income, you can file separately. But, again, you would lose out on the advantages of filing together.

I am a stay at home house wife and have been for years and we always file joint, I am not sure why you aren't able to but I would find someone to help you. I don't see how you could file separate when you had no income there would be nothing for you to file.

Married Filing Seperate Return --

Even with no income it gets you signature on a return differnt then his. A good move if you think is is evading taxes -- of which you could be liable.

Better move is to tell him to clean up his act or your gone and turning him in.

No unless she has made and can prove some sort of income. My soon to be ex took and did the rapid refund real quick claimed both kids & Im getting screwed. I have to pay & she made off with 3500 bucks!

i dont think so, i think you have to make over 6 grand a year to file head of household. you have to have income to file on

If you do not have an income you do not file for income tax.The working party claims you as a dependent.
