Everytimes I leave my wife and ask for a divorce she says she won't sign papers.
When I leave her she tries to over dose and goes to the hospital. I'm sick of the whole mess and want out. Where can I get answers about divorcing her.

It depends on where you live. Some states require both signatures, most don't. The answers you can get from a family lawyer, or you can ask questions in the court. If you live in States, go to the Superior court of your county and ask questions there about the divorce process. If you desire to hire a lawyer, call to the State Bar of your state and ask them to recommend you one. Don't just hire someone from the yellow pages. Child support, spousal support, the division of property are ones of the many issues you will have to deal with during the divorce.

Also, when a person tries to overdose, he/she doesn't go (!) to a hospital. The ambulance arrives and picks them up. I can only imagine the frustration she adds to your life.

Yes. It is considered a contested divorce. But, one party cannot keep the other party in a marriage if they don't want to be there. People have a misconception about "signing the papers". When you sign the papers, you are signing a settlement for divorce. Generally, this means the divorce will not go to trial. Both parties have split everything up, and come to an agreement.

If one party will not sign, or agree, then it goes to trial, and the judge grants the divorce, and settles it there.

Generally, these take a little longer, but in the end you will get your divorce.

If you live in the U.S. there is no state that requires both parties agree to the divorce. You are also not required to file for a ‘fault’ divorce if your spouse won’t agree to it. You can still file for a no-fault divorce (ie irreconcilable differences) but your spouse can contest it, and then it becomes a contested divorce. The judge will still grant it (a court will not force someone to remain married if they don’t want to be married), but it will likely take longer and be more expensive.

You need to check the laws of your state. Some states have a required separation period (6 months or a year usually) before a no-fault divorce can be granted.

In the UK you have to wait 5 years to divorce without consent, but you can live apart for that time and should be living apart for at least the last 6 months before you apply. It's a long time to wait but if you really want a divorce and she won't sign then it's better than nothing. Speak to a solicitor, I don't know where you live so the laws could be totally different there. She needs psychological help as well if she is trying to kill herself, do something about getting her help.

Yes, you can get a divorce w/out her signing the papers. You will have to file for it and when she never signs then the Judge will automatically grant the divorce in your favor. It may take a little longer to happen, but you've waited this long.

you can get a divorce even if she wont sign paper (unfortunately here in Ireland if they are not agreeable you have to wait 5 years but still leave her if your not happy. I thank god only have 2 years left to wait as I am in the same situation. Hope it all works out for you

Yes it is possible to divorce without ex signing papers, there is a form to fill out to say you have tried and she wont sign, she will then be advised of court date and she can make her pleas there if she wants, not that it will be to any avail.

She does not have to agree on divorvce . You can take her to court and sue for divorce weather she likes it or not. If you have kids involved take them with you there was a woman here in vegas that stabbed her 7 year old daughter to death after her husband left her .

its called an at fault divorce its expensive but not as expensive as if you have kids... good luck.
ps don't sleep around till your legally sperated papers signed and everything because it can still be classified as adultry
