I was fired from my job 5 months ago. The employer did not respond to the telephone hearing and I was granted unemployment. As if being let go wasn't enough, now, the employer wants to appeal and has requested a hearing. I wasn't worried at all because I was fully honest when I had to apply for unemployment. Mysteriously an envelope landed in my mailbox (not postmarked) with a document stating that I voluntarily resigned my position, a complete lie. Another document in the mailbox was a statement of why I was let go which was never given to me nor was it ever explained to me nor did I ever have any knowledge of any of the reasons stated. Actually, the reason I was given for being let go was not even on the document. The document was a complete set of outright lies. (Funny the documents were not run through the postal system) I was never given any discharge papers nor did I ever sign any dismissal papers. A lawyer wants much $$ to help. what do I do?

Firstly, don't ever mention the unpostmarked information. It is useless, and was likely provided in hopes that you WOULD mention it and the previous employer can claim they were given to you at time of termination because they didn't mail them to you. As far as the claims about reason for termination, its your word against theirs EXCEPT, none of the documents have your signature on them. That plays in your favor, because (im not sure on this) I believe there is a law requiring you to agree to the terms of termination with your signature. You don't need a lawyer, but you do need to attend the new hearing. I missed mine because I moved before I ever recieved a date for it, or a contact number for them to reach me at. They can and will go through the hearing without you, and theres nothing you can do once its completed. Bottom line, be sure the unemployment agency knows your side of the story, and the fact that the former employer has nothing with your signature on it saying otherwise.

Who ever put that in your mailbox without postage, is in violation of Federal Law. Take it to your post office, show the Post Master, let them make a copy. Make a complaint, with copies to the U.S. Postal Inspector Office in your state. U.S. Postal Inspector will go after the person who did this. You do not give up the original letter or original envelope, keep it , it is proof. You need to rattle some chains about these no postage documents that was in your mailbox, the guilty party will have a lot more problems than you have right now. You might want to appeal your case, if your checks have been stopped, and these documents you have , can only help you, not hurt you. It seems you have a very good case, you need to find a lawyer to help you with this.

When you go to the hearing take the papers with you. Document all the events, getting unpostmarked letters and any correspondence you may have. If your right and they are wrong, you shouldn't worry. If you never signed anything pertaining to your discharge, make sure your x employer hasn't forged documents in their favor also- if so, Demand handwriting analysis if you have to.

i do not think the papers are legal in court... dismissal papers are usually signed by both parties.. I would call the labor board. Also check with the the local court (local for the company) and see if anyone has filed any claims against the company.

I don't know where you are, but Texas has a time limit on unemployment. I think it's six months. You were fired five months ago--go get a job for chrissakes!
Now if only there was a time limit on welfare...

you are entitled to 13 weeks unemployment. the government has overpaid you. get a job and pay it back freeloader
