What is the difference in formalities between annulment and divorce?

An annulment is Britney Spears and Her First Husband, less than 72 hours, the marriage DIDN'T happen.
A divorce is Britney Spears and Kevin Federline the marriage did happen but it didn't work out and they are getting a divorce legally she could still be known as Spears/Federline but with all her money I'm sure she won't have that.

After an annulment, the marriage is considered null and void (ie. it never happened) - Not the same with a divorce. I believe there are strict restrictions as to what would constitute an annulment - for example, if the marriage was not consumated, or if there is evidence of fraud on the part of a spouse. I'm not sure of the other reasons to justify an annulment - anybody?

An annulment is a hassle free way of making your marriage null and void. You can only get the marriage
annulled if you have been married less than one year.

There is no property to devide up legally. Both parties just cut their losses and go on with life as if it never happened.

It's a lot cheaper than a divorce. You only have to pay the clerk of court's office the filing fee to annul your marriage. Hassle free and cheap.

BUT...If you have been married 365 days...That's one year and then you would have to get a divorce.

Annulment is declaring the marriage null and void. For example, if a spouse was already in wedlock of another, or spouses are within prohibited relations and the marriage was performed, it can be annulled as if no marriage was ever performed.
Divorce is a judicial separation which liberates the spouses from wedlock. If not with mutual consent, the spouses shall have to allege lawful grounds for divorce before the court and to prove them by acceptable evidence to get a divorce.
Despite divorce or annulment, the court orders the spouse having sufficient means to pay for the survival of the spouse who is unable to maintain.

An annulment erases the marriage as if it never happened ( people of religions that frown on divorce use them ). A divorce dissolves a marriage.

annulment means that legally, the marriage never existed in the first place. Divorce is dissolving the marriage once recognized by law.

an annaulment meas that you were never really married so you dont have to worry about prenups and division of property plus its much quicker and less expensive then a divorce.
