Does anyone know the laws on a person pulling out a camera and taking pictures of you. I have an EX-Wife that will follow me around and take pictures of everything that I do with the kids. She has gone as far as to tell the kids that these are for the Judge, I consider this harrasment, stalking, and invasion of privacy. can anyone tell me if this is right or not

Your specific situation sounds like harrassment.

As for the picture-taking itself, you're in public, and thus you are no longer entitled to a "reasonable expectation of privacy."

The rules and laws vary from state, however the general rule of thumb is this: Anyone can take picture in a public area of anything. Anyone can take a picture of a private area Only from a public area. Unless they have permission of course to enter the private area. NO picture with with people in it may be published without the written consent of the person in the photograh. However taking pictures of people in public for private use is a gray area, you may ask the photographer not to, or you may ask the local law to request the person to stop. It is up to the local law and policy to decide if they will inforce privacy in a public area.

Yes it is a crime and yes it does fall under the elements of stalking. Unless there is a court order which prohibits you from having the children (in which case you obviously would be in violation) she doesn't have the right to follow you and invade your privacy and encroach on the relationship you are having with your children. If you and her are divorced there should be a clause in your settlement that indicates that neither party will talk poorly about the other party in an attempt to pursuaed a disadvantaged relationship with the children. In California this is generally listed in the Addendums section III Subsection C related to Child Visitation. Now would be a good time to reread your divorce agreement.

I know as far as photos go, you're pretty much screwed while in public. If it is annoying, there's not much you can do, if you can prove it's harrassment and stopping you from your daily activites...then you'll need to hope you have a judge that cares. It's really hit or miss.

as far as a restraining order goes, unless you take it out on the person taking the photos...you'd have a hard time with evidence to prove it's the work of your ex.

Different states will vary, but it sounds like a form of harrasment, so document all the times she does this with time and dates and even a few photos for yourself. This is real childish behavior and could actually play in your favor. The problem also is that anything in the public view, is open for the public use,,??? Good luck, cause with a woman like that, your going to need it.

truly no longer, not in any respect, no way. I easily have not in any respect heard one of those ludicrous theory. if you're in public then you are straightforward pastime both because the challenge or only in the historic past. only how precisely do you imagine one of those ingredient might want to be enforced in the midst of London or the like? Taylor-sunlight - in public there is truly NO requirement to get the permission of all and sundry to take their image. similar for publishing the picture (in the united kingdom besides).

She has a different motive than other people who would take pictures, you can get a restraining order if you can convince the judge that this poses a threat to you or the children, good luck

You need a restraining order. But taking pictures id not illegal. Until you get the order keep a sign with you that reads "stop harassing me" and whip it out when the camera becomes active.

Taking picture in public is not illegal. But following and stalking you might be illegal. Call police if you feel insecure.

sounds like a head case to me...lol...if she's that worried what you do with the kids then why does she let u have access to them?...maybe she is still into you and is using the kids as an excuse....idk, but it sounds like she maybe a little physco...call the cops and see what u can do about the situation.....
