I live in Canada Toronto...currently I live in my own condominium apartment. I live alone and sometimes my friends come to visit me..due to that I've been receiving lotsa noise complaints...:((( and recently I received a 'registered regular mail' where it states under 'Corporation Declaration' Rules 6,8,14

'Owners, their families, guests, visitors and servants shall not create or permit the creation of or continuation of any noise or nuisance which, in the opinion of the board or manager, may or does disturb the comfort or quiet owners, their families, guests...etc..'

also it states
'Pursuant to section 29 of the corporation's declaration, you are required to reimburse York Region Condominium Corporation No. 1053 for the cost of this letter in the amount of $477.00 ($450.00 plus G.S.T)

What I don't understand is..all of the noise complaints were made before 11:00pm...I ask a security guard about it and was told that i was not permitted to make noise at any time..whata hell?

where does it state under Condominium Act that I can't make noise at any time? it means that I can't even flash my toilet at any time?

that's exactly what I mean...they didn't specify the time in the law...and security guard told me that I can't make noise at any time..but that's bull..so that means that if I'm using my vacuum cleaner and someone can hear it then it's a noise complaint? lol..this is ridiculuos..

normobria.. I understand what you're saying..but what if it interferes with my daily activities? so what does it mean? i can't even hammer a nail into the wall? i need solutions to this problem not more problems..

Every apartment resident in any building in the Western World is entitled to what is called 'quiet enjoyment' of their own apartment. Your neighbors can sue you directly for making noise that interferes with that 'quiet enjoyment'. By belonging to a condominium association, they have assigned that right to the board, which is now informing you that you are in violation of civil statutes. Their rules are irrelevant in this situation. Too much noise at any time of day is grounds for a civil lawsuit.

That's why only idiots join associations or subject themselves to the arbitrary rules of someone else. Just see what happens if you park your car slightly askew in your space. They'll probably have it towed.

Take a look at the Condominium's Community policy yourself....also sounds like a place that isn't built well enough (cheaply) for condos to offer more privacy. I lived in a condo before and that is why I sold it out....thought the ordinance was ridiculous and having company in my OWN home from time to time is not anyone else's decision but mine....I owned the place and paid the taxes...

Sounds to me that you've gotten yourself into something that is caused by others that are not as social as you and they are cold. You obviously don't have the choice but to pay the fine and then maybe let your friends know about the situation, it isn't your fault that those that wrote the ordinance, & living around you are snobbish and full of sh&t...

To have to live somewhere as an adult, even if you're responsible as an adult, and take orders on how to live in your own home is wrong! Whoever is on the commission of the condos are a bunch of snobby jerks and they should be fought against...your home isn't theirs.

That pretty much says it all. If people are complaining that means you're in violation of the rule. I suggest you either stop making noise or find a better place to live. If I were you I'd choose the latter as I would be ready to kill the whiney losers that complain about the noise.

If you really want to stay in that building I suggest you talk to your neighbors and find out who you're bothering, and what you can do to make them stop complaining.

The rules are fairly clear, and even though they are BS rules you do not own the apartment building and they get to tell you what to do.

My advice is to pay them the $477 - then give them the finger and tell them you rented out your appartment to a family of circus clowns.

well i dont know how it works there, but here where i live as long as youre not making anymore noise than whats considered "normal activity" they cant do anything. also i dont know how they can bill u for supposedly breaking rules when they cant really prove it, unless it was multiple neighbors. but i dunno maybe it works differently up there. in any case, u should fight it with whoever u can.
