I work for a credit union, and part of our employment policy requires all employees to complete a required 5 hours per quarter of "community involvement," such as participating in after-hours business events and tradeshows. If an employee does not complete the required number of hours per quarter, they are marked down on annual reviews, or worse, they are written up. Is this legal?

An employer can require employees to participate in business-related events and marketing activities, assuming that it is part of your job. If you are in a management capacity, it is most definitely a requirement to promote the values and benefits of your organization as a representative of management.

Community involvement is one of those items that can be used as an incentive, but should not necessarily be used as a detrimental item on evaluations. If it is explicitly stated that you are required to perform these duties as part of your job, then it can be a measurable part of your annual review.

I am not sure, but I think that if you knew it was a requirement and agreed to it when you took the job (or worse, if you have an employment contract stating this and you signed it) then I think it is legal. From what I have been told, without some type of employee protection in place (example, a union contract) employers can pretty much do what they want. Plus, one person complaining will not do any good, and good luck getting other employees to back you up.

If you are not an exempt employee, this would almost certainly be a violation of the wage and hour law unless your employer pays you for it. If you're paid, or if you are an exempt employee, then it sounds legal.
