My fiancee just got sentenced, he took a deal for 3 years with half. So we're assuming he'll do 18 months, the judge gave him 21 days for good time work time and he had a month and a half actual time. How long will he actually do with the over crowding etc... What percentage? We are in California. Thank you!

Overcrowding has resulted in early releases from some county jails, but not from State Prison, which is where your fiancee is going. He is eligible for 1/2 time credits but he will not start earning them until he is actually in prison. (BTW, the poster who said this depends upon the offense is wrong. There are some offenses which do have lower credits available, but if he is eligible for 1/2 time credits that will not change.)

Until then, he is earning 2 for 4 (or 1/3 time credits). So to get a ball park figure, take his 1,095 days (3 years), subtract the 63 days credit he got at sentencing (equals 1,032), subtract any time in jail before transport to the prison, plus 2 extra days for every 4 in jail, then divide what is left by two. That will get you a close figure (misbehavior can add time, some particularly hazardous jobs, like fire camps, can reduce it even further). His counselor at the joint will give him a tentative release date when he gets there.

(California sentencing law does demand a degree in higher mathematics.)

It all depends on the crime that was committed. Just because some criminals get a shorter sentence in some cases does not mean that all sentences will be cut in half. The only thing I can say is it will be a wait and see deal. Im sure if he acts according to the rules in jail and doesnt do anything wrong, it will be taken into consideration.

Well i rekon he prob do 6 months but depends on what he did anyhow good luck!!!!!!!!!
