I have a friend who works for a big corporation and she isn't getting reimbursed for gas. Isn't that illegal? or is it just one of those "it's the right thing to do" things?

It is not illegal....and in some cases she can deduct the miliage for taxes but there are some stipulations to that.....

1. She can't deduct the miliage if she is driving from home to the office daily and thats it.

2. She can only deduct the miliage if she uses her car for work that does not involve going just to and from an office....for example...if she drive to the office, and then also uses her car to travel, run errands, etc....or if she is say in sales and uses her vehicle to make sales call all over a region, something like that....

There are not many people who pay miliage just for a commute to the office. I guess the figure it is that persons choice if the want to drive that far to work every day.

The majority of companies that require an employee to use their car or a company car for business give them a gas allowance. the reason they don't just let you submit gas receipts is because they can't control how much gas was used for work and how much was used for personal use. When a person is hired for a job that requires travel all expenses that are covered by the company are explained. If they did not state that she would be reimbursed for gas mileage, they don't have to pay her. I would suggest that your friend speak with her boss if he gave her a job that required her to drive her car she should submit an expense report to him. including receipts. any gas, tolls, parking costs should be listed. If they refuse to reimburse her, she should refuse any future travel, unless her expenses are covered.

I assume you are talking about using her vehicle for company business, and not just coming / going to work?
No, there is no law that says a company has to reimburse for gas. There may well be a company policy about it, but that is strictly between the company and the employee. I assume she has a supervisor, and it seems logical just to sit down and ask in a friendly way, especially if it is frequent.

No employers have that choice. So if she is reimbursed, she doesnt claim it as income but she cant take the tax deduction. If she isnt reimbursed, it helps her annual refund check

it is not illegal, as she can deduct her mileage on her taxes.
