I left my husband 2 years ago because of his drinking. I didn't push to sell our home because our 2 children (although adults) still lived there, shortly after he made it difficult for them and they moved out. I moved into a flat and payed rent and had to buy everything I needed as I took nothing from the matrimonial home. We are now selling up and he thinks he should deduct the amount of mortgage he has paid since I left from the proceeds of the house sale. i argued that I have had to pay rent, his answer is that it was my choice, it's as if he thinks I should be punished for leaving him. I want a 50/50 split am I right?

thanks for your answer todayills but my 'children' were 24 and 25 years old, and my husband was never a violent drunk, just didn't have a marriage with him because of it. I would NEVER leave my children in danger

had to answer naglfar, I left my husband with EVERYTHING, all the furniture, insurance policies, etc. I took my own clothes and personal effects and borrowed money to furnish the flat I rented. I don't consider myself a money grabbing woman

I think you are still entitled to half of proceeds considering you are still married. I think your husband is taking you for a ride and wants to punish you more..
I don't think you will find to many family lawyers here. Perhaps you could seek advice from one. Or look up a the family court website in your area and perhaps more information will be there.

Afraid he's right. When you left and he took sole responsibility for the upkeep of the house that changed your legal position.
You need to get legal advice and have the finances sorted before your divorce is finalised. But you should get 50% less what he has put in with mortgage payments and any decorating etc.

Is your name on the mortgage? If so then you have a pretty good chance at a 50/50 split, go and see a solicitor or try www.diydivorce.co.uk.

check with your attorney...depending on the state you live in..it could be considered abandonment of the property because you just left it and everything in it...
He might have you in that he has been paying for the mortgage and the upkeep..whether you paid rent or not...
Were you collecting allimony or anything from him???
More than likely whats going to happen is a judge is going to have rule on this one and look at all the facts and decide for you...

you will end up going for mediation thats when you sit down and make an agreement who has what. you could ask for half the value of the house and that way he would have to gat a 2nd morgage and give u some. other than that if you dont want anything it should be pretty strait forward,but if i was you i would and ur ex is working and able to get a 2nd morgage id ask him for some sort of settlement. goodluck and good 4u.

the truth is youre probably entitled to half, even though he is the one that has kept the mortgage going for the last couple of years. Divorce law BY FAR favours the wife over the husband, regardless of his or her circumstance.

we sold up and went 50-50, he wouldnt be able too do that, he lived there!!!!! he,s punishing you my ex husbands favourite words are "you,re choice!" i left too, if your name is on the mortgage you are intiled too half, and if you left with nothing id be looking for half the value of the contents if they were purchased whilst you were married!! through that one at him, go to c.a.b they do give great advice all the best x
