"i drove 104 mph on the motorway because i was rushing to get home because my mothers not well, a speeding fine came through the post today , will i get banned??? arh.......

At this speed you will almost certainly have to go to Court. The court will hear your case and if you get a good defence solicitor they may be able to plead mitigating circmustances and they can prove that loss of your car can damage your work then they may get your sentence reduced to 12 points on your licence.

However 12 points will stay on your licence for 3 years and any motoring offence committed during this period which is subject to penalty points will result in a ban.

The other option that your solicitor may plead for is a shorter ban, this can be as short as a week. After which you can drive and you have no points on your licence.

It also depends on how severe your mothers illness was, i.e. if it was life and death the court may be more lenient than if she had just had a broken arm for example. Your solicitor should be able to advise you how strong your case is.

Basically it all comes down to the court on the day.

Your Notice of Intent to Prosecute (NIP) which you received through the post will have a stated speed this may not be the 104 mph that your speedo on your car registered as some car speedos can be up to 5% out especially at high speeds. If the speed on the NIP is less than 96 mph you may get upto 6 penalty points and a fine of 230 GBP. It is the speed stated on the NIP which determines the penalty.

Most times 100mph+ is an auto ban. Does it ask you to appear in court?

The fact your mother wasn't well and your a nurse wont go down as any defence in court. They may even argue that as a nurse and see the results of speeding drivers accidents you should know better.

More than likely you will have to go to court. A ban is possible! Points and fine for sure. Plead your case and make it clear how losing your license affect your work etc! Admit to driving to fast and be sure to impress on them how sorry sorry sorry you are!

Ive known biker friends get off with worse.. Luck of the draw as to who is sitting in the chair and how sincere they view you..

if it is the first time speeding then you will prob get a fine
hope this help's.You mite get about 3 point's but not a banned

you say a fine came through the post .......was it a fine or was it a court appearance

if you drive over a 100mph you will be banned

you usually have to appear in court when you drive at that speed

at 104 most probably you could get jail as well,iv'e always
said drive like there is a policeman behind you, carefully.!
