My husband told me he would never divorce me. There has got to be a way out without him contesting. Hes a good guy I just need to be alone and free.

File all the papers then hand them to him to sign, but at some point he is going to find out.

California is a no fault divorce state. Is your state? I know it sounds dramatic but if you want a divorce there is nothing your hubby can do about it, he can't prevent it from happening, he can't stop you from filing and he can't stop the judge from signing the dissolution papers.

You tell him you want to be free and if he wants to stay in your life and have any chance of being your husband again then he better start acting like a friend you would want to keep around.

And tell him, he's a good guy you just don't want to be married, at all. and then move out and file for divorce. Men never believe anything is wrong until the woman moves out. That is like some big que to them that something is wrong. Most men don't listen, they tune out what they don't want to deal with.

Good luck girl, sounds like you know what you want, and there is nothing in the world that your hubby can do to stop you from being free.

PS. Both spouses do not have to agree to a divorce, a judge can rule on it. An unwilling spouse's signature does not have to be on a dissolution for it to be legal. Marital settlement agreements are a different story. Call an attorney, the sooner the better, you are going to need one to process the paperwork anyway.

Well if you wanna get a divorce he has to know but you can go to a divorce lawyer and get the divorce papers and then have him sign them after you sign them but you cant get a divorce without your partner knowing about it.

Talk to a divorce lawyer. He can guide you in the right direction. You don't have to stay in a marriage just because he doesn't want a divorce. It may be a good idea to talk to the lawyer without telling him first, so you can find out what your options are. If you think that your husband would get violent, please be careful and mention that to the lawyer.

Yes after 5 years, my hubbys ex try to stop him divorcing her using the children. The court wrote back refusing the divorce on these grounds. I then wrote a letter on behalf of my now hubby, stating his rights as per the 5 years rule and the matter of the children will be dealt will. The divorce was then granted she was not happy ha ha ha who cares, silly woman, he is the best guy I have ever known

He's a good guy, but you want to be free? Then why the heck did you even get married? Let me guess, you found a guy you like more and want to get out there and party. You can set up a divorce, but he has to agree and sign it.

He needs to be in a coma. I think that is the only time you do not need his consent. That or if he is in jail.
Now you can get a divorce with him knowing but not agreeing and that is a different question.

How long have you been married? Maybe you can get the marriage ANNULLED (like it never happened). Otherwise, no way out......get a lawyer, file for divorce, you husband will be an EX before he knows it!

He would need to be served with papers so you cannot divorce without your husband knowing.

Why are you giving up on your marriage?You said he is a good guy? the only reason divorce is allowed is if your spouse is unfaithful.God cares for you,please cast your worries upon Him, he can help you...... He hates divorce....Jesus loves you
