MY EX AND I BROKE UP 3 MONTHS AGO AND I AM CURRENTLY SEEKING CUSTODY OF MY DAUGHTER. SHE JUST UP AND MOVED AND TOOK MY DAUGHTER WITH HER AND NOW I HAVE NO IDEA WHERE SHE MOVED TO. MY LAWYER CLAIMS THAT SHE HAS NO RESPONSIBILITY TO HAVE TO LET ME KNOW WHERE MY DAUGHTER PHYSICALLY RESIDES (AN ADDRESS) AS LONG AS SHE SHOWS UP AT THE POLICE POST AT THE COURT AGREED TIME TO EXHANGE MY DAUGHTER FOR VISITATION. IS THIS REALLY TRUE OR DO I NEED A NEW LAYER?

You need to at least visit with a new lawyer. I don't know where you live, but the issue of child custody in my state is based upon "what is in the best interests of the child." I don't know where you live or how old your child is. My state has to consider joint custody. The Courts cannot give preference to the mother over the father because the equal rights amendment is in our state constitution. Although I can't provide you with a satisfactory answer because I can't identify your location, in my state one parent could not conceal his/her location unless the marriage was violent. I would strongly recommend a visit with another atty. The longer you wait, the harder it will be to get custody. The Courts do not like to disrupt a child's life. In fact, in my state, your ex would not have be allowed to move to a different school district until the end of the school year.

As I'm sure you know, each state has their own laws, so something I tell you is the law in my state, probably isn't going to apply in your state. I would make sure I had an attorney that is very versed in child custody laws, not one who specializes in bankruptcy, for instance. You know what I mean? You wouldn't go to a dentist if you needed a chiropractor. Check your phone book for lawyers who list child custody as one of their areas of expertise and then call and see if you can get a free consultation. Even if you have to pay, it's usually not much and will be well worth it since you're fighting for your daughter. I am wondering why you're fighting for custody...are you just angry or is the child really in danger somehow? Make sure you look deep before you take that kind of step, raising a child isn't easy, rewarding, but not easy and if you aren't in a position to do it, you'll be spending a lot of money on a lost cause. If you're heart's in the right place I wish you lots of luck. Just always think of your daughter first...and of course you have a right to see her, unless there are circumstances that led your ex to keep her from you...and only you know that.

this is true you do not have to know where your daughter lives or for that matter who is living with her in the home. that is not some thing you need to know in order to raise your daughter. and on the flip the mother doesn't have to have your address or know who you introduce your daughter to either. as long as she is not in danger or being neglected all you have to do is be accessible to received and drop her off at the station

Each state has their own laws, in most states it is the law that you know where she lives, unless she has an order of protection against you, or the court has ordered that you only have supervised visits.

I'm not an official on this but i have had the same experience. no they don't have to tell you where they live.
