Felony is defined as: a crime that incurs at least one year in prison as a punishment.

For North Carolina, this means your third DUI/DWI (1 year mandatory sentence).

For South Carolina, it is your fourth DUI/DWI conviction (mandatory one year sentence).

Of course, other factors related to the incident MAY mean you get a felony charge earlier, but it won't be for the DUI/DWI specifically.

First of all DWI's are not good at all. The first one is not a felony. They are counted 1,2,3. The fourth one is a felony and it is possible to get some prison time. Watch out though because if you hit and kill someone during the process you can get charged with manslaughter which is much worst than a 1,2, or 3rd DWI.They start over after five years.

If there was an accident and someone died YES it would be a felony. BUT just a first offense DWI, no, it is NOT a felony.

Every state is different with thiese charges. I am from Wisconsin, and they are VERY strict on DWI charges. Especially when you cause an accident that causes injury.

I think it's only a *felony* if you kill someone while you are drinking and driving.

Other than that I think it is a misdomeener. (spelling, sorry)

Not usually. It's your third or fourth that is a felony.

In New Jersey it isn't even a crime it is a driving offence.
