One of you will have to petition for the divorce. It cost $240 dollars to do so with the District Clerks office. Then there is a 60 day waiting period.

Other than that, if you agree to everything as far as how to split everything, visitation & child support(if you have kids), you draw up a settlement, sign it, wait the 60 days, and then the judge will grant it.

There is never a mutual divorce procedure! After a time, someone who talks with some backyard lawyer will switch to nasty mode, and everything you worked for up to that point becomes null and void. There may be another option.... a mediator. I have heard several couples that split were glad they went this direction. Two of them because they mediated right back to married life. And they seem to be doing fine. They appear more mature, which is a big change since most couples that split are very childish. Last thing I would suggest is to not divorce. Make it work! Love is an action, prove this theory!
