In China, the death penalty targets poor and marginalized groups including ethnic minorities, migrant communities, political dissidents, and so called "separatists". Since the “war on terrorism” began, Muslims in the Xinjiang Uighur Autonomous Region have been the target of intense crackdowns, and political dissidents may be labeled as 'terrorists' and sentenced to death, regardless of whether they have used or advocated violence, and regardless of whether they have been implicated in any crime.

There are few standards in the application of the death penalty in China and sentences often depend greatly on the political climate and timing. For example, crimes which would ordinarily bring a lesser sentence are often punished by death during a so called "strike hard" campaign. White collar criminal cases may be given the death sentence to make an example or highlight anti-corruption efforts. Executions also tend to be clustered around national holidays including National Day or the Chinese New Year. Chinese officials have even commemorated International Children’s Day by holding grim rallies around the execution of several prisoners.

So called “Strike Hard” campaigns are periodically launched by local leaders as a means of cracking down on crimes such as drug related crimes or corruption. During the campaigns, sweeps net thousands of arrests, and prisoners may meet much harsher punishments than would otherwise be given under normal circumstances. Executions skyrocket during these campaigns; the most recent national Strike Hard was launched on April 11, 2001 with 89 executions in a single day. By the end of 2001, more than 2,468 executions had taken place.

China currently executes more people each year than the rest of the world put together. According to Amnesty International, at least 3,400 people were executed in 2004. This is 90% of the reported world total. A senior Chinese legislator suggested in March 2004 that China executes "nearly 10,000" people each year.

# Capital punishment is applied flexibly to a wide range of crimes, some of which are punishable by death in no other judicial system in the world. Economic crimes such as tax fraud have appeared routinely among the dockets of those receiving the death sentence, as have relatively small-scale drug offenses. Death is also frequently imposed on repeat offenders whose individual crimes would be considered relatively minor in most judicial systems, such as non-violent theft or causing incidental bodily harm that is not life threatening or debilitating. Capital punishment is also imposed on inchoate crimes, that is, attempted crimes which are not actually fully carried out, including repeat offenses such as attempted theft or attempted fraud. The recidivistic nature of the offenses, not their seriousness per se, is what is adjudicated to merit the capital sentence.

Capital punishment in China can be imposed on crimes against symbols and treasures of the state, such as theft of cultural relics and the killing of pandas.
