I have been living in this apartment for one month now. Since day one the above apartment has a child (rougly about 2 years old). I understand living beneath someone their is going to be noise. Such as hearing their washing machine, T.V. and hearing people walk. I also hear this child run constantly which is part of being a child I know. The issue with me is the constant running and jumping late at night until early morning. I am being serious, the child has woken me up from bed at 2 in the morning. I work from 8 to 5 and I need my sleep. I usually go to bed around 11 and it's so hard for me to sleep due to the running and jumping all night long. I talked to the Mother upstairs and explained to her the situation and she apologized and would settle the child down. A week went by and still the same. I called the landlord and he said he can't do anything about it. But in my lease it has rules bout the disturbance of neighbors being an issue. What do I do now? Thanks!!!

move and sue for rent paid. As a landlord, it is his responsibility to keep his other tenants under control. It's so hard when you don't want to cause problems with the neighbors upstairs, but calling the cops is also another option. that way if you were to take the landlord to court, you have proof that you did try to take care of the situation.

this is a case of bad parenting i also have a 2 year old and if she was running around at 2 am i'd go crazy some people just don't care how they raise their kids the parents obviously need parenting classes and when you move make sure you have firewalls in the next place i live in a town house and a week or so ago there was a fire truck pplice car and an ambulance in our drive way getting one of our neighbors and we had no idea it didn't wake any of us the only reason i even knew it happened is the nosy busy body stopped by from a few houses down wanting to know what happened fire walls are awesome when you live in a apartment type setting threaten these parents with a call from child protective service if the kids running aroung all hours of the night and the parents just sleep through it they shouldn't be parents kids that age can get in serious trouble or injury with out supervision

I had the same problem when I was living in Germany. I kept asking and asking for the kid to go to sleep at a decent time, so that I could, too.

Of course you could always call the cops due to 'disturbance of peace', or the usual laws surrounding apartments of 2200 being the beginning of quiet time.

Let your landlord know. Don't worry about looking like a jerk. Sleep is more important, and that child shouldn't be up so late, anyway.

its hard to understand how a parent can allow a 2 year old child to run around at 2am . A child should be sleeping at that hour. I know children can wake up with the sunrise, butt there is no excuse for that kid being up at 2 am
I believe that the mother is not doing something correctly. Perhaps another talk with the mother can help. If that dont work, let me go talk to the mother and tell her either shape up or get spanked by me !..LOL

Record the noise on a tape and tell the landlord that you will sue him to get your money back because he/she did not do anything to enforce the rules on your lease.

That child should be sleeping through the night!

Talk to the landlord and tell him that you are going to hold three months rent because you are going to move out due to the noise upstairs. Go to Landlord tenant court and report it. Good Luck!

Give to them what they give to you.
Ring their phone and when they answer, hang up . In fact , hang up before they answer .Just let it ring once or twice . Especially when they are sleeping, wake them up. So there . I got that off my chest . Nothing bugs me more than noise when I need to sleep .
