I have a girlfriend of about 8 months we have no kids but the relationship has gone down hill. What is a postive method for her to leave my residents and the steps to do this efectively? Of course in an accordinance with ohio law..... She has also been physically abusive a couple of times to me when i have expressed my concerns about this dead end relationship. I have a 5 yr old son whom lives with me also...

Well if she hits you again, call the police have her arrested, then file for a restraining order at the courthouse the following day(you will need the police report#).
If you don't want her to have a police record.
Give her a 30 day notice to vacate the property or she will be evicted. (you can find these at office supply stores)
or
Change the locks

YOU'VE GOT TO BE FRIGGIN KIDDING ME! After only 8 months you have exposed your 5 year old son to an abusive woman, and now ask for advice on how to get rid of her? Well no offense my friend, but father of the year you're NOT!

Try this............send your son to grandmas for the week in case things get ugly. Tell your girlfriend that it's over and that she needs to move out by the end of the weekend. As long as her name isn't on the lease, she has no legal rights to stay. Call the police to let them know the entire story, so that if you DO need to call them they will already know what's up. If you have to, and be prepared to get a restraining order. Then if I were you I would look for a new place to live. Unless of course you're not worried about looking over your shoulder every time you open your front door to come home.

PS: Next time be a little more selective about the women you invite to come live with you and your son! The best sex in the world with the kinkiest chick you can find isn't worth your son's safety and well being.

Is she helping pay the Bills/Rent ect? Is her name on the lease? If Not I am not sure she has any rights as far as legally. You certainly do Not need anyone like that around your child. If you are afraid she will raise H*** if you ask her to leave, Pack her stuff up and put them outside the Door, but make sure you have ALL of the Keys to the place, and park your car where she cannot get to it for awhile. Women have a tendency to seek Revenge when they are Hurt and your cars gonna take a Huge Hit/Scratch to it. That is always Hard to prove she did it, but at the same time you know she did and she knows it also, so her point gets across. If she has permission to pick your son up at DayCare or School, Make sure the School knows whats going on, so your son will not be released to her. Hopefully she will move on and leave you and your son alone, but be prepared for a Battle just in case.

You need to sit down and talk to her. Let her know that it just isn't working and that you are unhappy with the situation and you think it's best if she leaves. If you are afraid that she may get violent, have a friend over, but not in the same room as you talk to her. Have him wait in the bedroom. That way, if she does become violent, you have backup.

Now, if she is on the lease, you may have to talk to the landlord and see what it'll take to get her off the lease.

It just may be the easiest for you to leave. Again, talk to the landlord to see about getting yourself off of the lease.

If you have a mortgage and she is on the loan, that may require an attorney. If it's in your name alone, then a 30 day notice for her to move should be sufficient. If she absolutely refuses to leave, then you can have to police physiclly remove her. DON'T FORGET TO CHANGE THE LOCKS!!!

What are you waiting for Tom, just ask her to leave. By the way, whose house is it? Its not good for your son to have that kind of person hanging around, that's some pretty good argument as well. Ask her to leave nicely, then if she insists on staying, just serve her with an eviction notice. All in all, you should really stand up to her and tell her like it it. This could be dificult because of your personality type, but if you don't do something about it, you will be emotionally distressed and your son will not be able to enjoy his father. U r in my prayers.

Not sure why she would want to stay there now, but if the place is in your name you should be able to just change the locks and put her stuff out to the curb. I would ask her to go first and if she won't, get a restraining order on her and put her out. Your son does not need to see or hear any of this. If she is abusive towards you, it shouldn't be hard to get the order.

Go to the local court and file an eviction. In MI that part is free if it goes to court there could be court cost involved. check your law..here it doesnt matter if your name is on the lease you can establish residency by recieving mail at that address so it might not be as easy as saying get out. Good Luck

IF SHE'S NOT ON THE LEASE OR MORTGAGE... BYE BYE! IF SHE WON'T LEAVE PEACEABLY, YOU CAN HAVE HER REMOVED BY THE POLICE.

YOU CAN START OUT PEACEFULLY BY ASKING HER NICELY TO LEAVE. THEN, IF SHE DOESN'T, IT'S YOUR RIGHT TO CHANGE THE LOCKS WHILE SHE'S OUT. IF SHE CAUSES ANY TROUBLE, THE POLICE CAN ESCORT HER TO YOUR HOUSE AND SUPERVISE WHILE SHE REMOVES HER STUFF, BUT THEY WON'T FORCE YOU TO LET HER STAY THERE (AS FAR AS I KNOW).
