Your marraige is still legal until you will file for divorce and get a final decree in your hand.
My ex was separated with his wife for 13 years and didn't complete his divorce. He couldn't find her even with a private investigator by SSN. She got married after that like 3 or 4 times but never completed divorce with him.
So my ex decided to marry me and filed that he never been married before. Well guess what since he married a foreigner all this crap poped out and our marriage was illegal.
We went to the lawyer and she said that by GA law if you can't find your estranged spouse you can post an advertisment in the newspaper for 30 days in the town where you think she lives in that you filed for divorce and if she won't show up and protest against it court will grant a divorce decree.

I don't know about other states laws but I'm sure they have something similar to that. Btw, it will cost you much less than go through court with a lawyer. You will have to use a lawyer to make this project legal and with they help you can push it through court faster but you won't have to come to the court over and over again.

The marriage subsists unless u received a notice of divorce from the court and ignored it and thereby suffered an ex-parte proceedings.

first of all your let me start out by telling you that your marraige is still legal no matter if it was 20 years ago she left you...second of all she can't divorce you unless you sign paper work....the only ways that you could have been divorced without paper work is
1. they can't find you
2. if they have tryed to get you to sign paper work and you won't sign
if these two examples do not aply to you then you are still legaly married....

you shoud have received papers if she divorced you. well it cold have been in the papers also and you didn't see it butyou can call the court house down town where you all lived and find out.

people tend to find ways to divorce someone with the need of the other's signatureits happend(ive seen it) call your local court house and see how they can help you.
