I was terminated from my job due to medical issues and a temporary medical disability (yes, I have contacted the EEOC, etc.) and I applied for unemployment. My claim was denied because they said I failed to notify my employer of my absence, which is a lie. I have proof that I did notify them every step of the way.

I am filing an appeal with the unemployment board and I was wondering if any of you out there have been successful with an appeal and what I should expect at my hearing? Any advice or tips would be wonderful. Thanks!

I was involved with an appeal a few years back....only it was just the opposite of your case, where they gave me unemployment and the employer filed the appeal.........I sat in a room with a previous boss and a mediator or judge of some sort heard the case and all documentation, and the conversation was tape recorded. I won the appeal made by my employer. Even though it's different from your situation, you'll end up with a mediator probably so my advice would be to be honest, bring any proof, write it down if you have to, bring any documents that might be proof, etc. Good luck.

Yes I was! They turned me down the first time...., I appealed it and had a phone interview with unemployment. I ended up explaining my story, and won! Don't get discouraged! Being denied the first time is normal! Trust me! I was a bartender and served a minor who had a fake I.D. and I won my case! Good Luck to you! Let em' have it!

The hearing should be pretty informal. It is held in front of an Administrative Law Judge. The employer will be invited to attend along with you. Just show your documentation to the Judge and he should decide in your favor.
