You can choose to have an attorney file for you or you can visit your local courthouse yourself, go to the circuit court clerk and they will give you the paperwork to file for divorce. Its always best if you both can agree on things out of court...it is a million times easier and cheaper for everyone. Good Luck.

Contact a divorce lawyer and they will help you with this. At some point, one of you is going to have to move out of the house or apartment. You can't get divorced while living together. that sounds like an obvious thing, but you wouldn't believe how many try to file for divorce, while living together, because neither will move out. In my case, I moved out, filed and never looked back. that was 5 years ago and I'm happier than I've been in a very long time. the first year is rough, but hang in there, it get's better.

Lex - First I would sit down and examine myself and do a sound self-inventory of what the dynamics are on paper.

You need to ask yourself strong questions and know exactly how you feel. Such questions would include.

Why do I want a divorce? Will I be better off without my spouse and marriage? What are the financial/emotional ramifications of pursuing a divorce? If there are children involved, what dynamics do I need to consider? Is my spouse willing to divorce also?,...and, can we agree on property and other issues to make it go smoothly.

You then need to find out if you live in a "No Fault" divorce state. Many states are now "No Fault" states where it comes to divorce, and this takes away the battle of whom was unfaithful, emotionally damaging, alientaion of affections and other issues as it concerns the responsibilties of either spuse where it concerns one's role in the marriage. This allows for a rather easy "fast-track" to divorce, but, unfortunately, "No Fault" states tend to force spouses to use their children's custody rights to be the ugly battleground for the failures and ill-will towards each other concerning the marriage to be played out using the children as the innocent party to wage such conflicts.

Go to your County Courthouse and speak to the Clerk of the Court's Office and personnel. They will tell you how to file for Divorce, and if uncontested and property agreements between both parties can be resolved between both, this will save a lot of headaches.

It can be a smoth process or a difficult one. It depends on what may be lingering between both that will dictate how smooth it goes.

Getting a Divorce is as big a step as getting married, and one should want to make sure they are taking such action for good and sound reasons. One doesn't want to do so without making sure it is not a temporary feeling that can otherwise be resolved by counseling or during a time-out of separation.

If you are lady, give food against wish / need of husband. In anger, he will take 1st step to get a divorce. Tasty food of personal choice is big hindrance in divorce.
