Who has custody of the boy? Over here (US) if the boy live with mother and stepfather the majority of the year the father cannot claim him on taxes. If the boy lived with the father for the majority of the year he can claim him on taxes.

That happened to me once. The IRS sent me a letter saying my ex-husband had claimed our son as a dependent and asking me who had custody. I fired back a letter saying he did NOT have custody. That was the last I ever heard of it. Don't know what happened to my ex, but I don't care, either.

The 1st one filed gets the claim. The second one filed gets kicked out to be looked into.
