I have a collection of cds that have accumulate from songs that I've purchased off of itunes that I dont want can I give them away without committing a crime?

Good question.

The making of a "mix tape" whether from sources you purchased or otherwise (such as off-air FM recording) for your own use is allowed by the copyright law. However you would certainly run afoul of the law by distributing (either free or for profit) any copyrighted item made with out permission. So basic rule is, personal use - OK. Distribute, bad. You might want to read the itunes user agreement for clarification as they could suspend your membership for reasons other than actual copyright infringement.

The RIAA has distorted this by going after illegal downloads. The download process, being a form of distribution, is illegal. It is not illegal to merely posses the file for your use on a computer, but it might be evidence of willing participation in an illegal act which is why the courts have allowed them search and seizure warrants.

It's techically a crime, so legally you shouldn't do it. That said, people have been sharing music for decades so I wouldn't let that deter you. Making a mix tape is technically a crime. The copyright laws need to be updated. So share your music, most artists would encourage it.
