My fiancee has to have his phone locked up every day that he goes to work. They put it in a safe, and he's not allowed to get to it. They also do not allow him to get personal calls at work, can they do that? I'm pregnant and worried that I might not be able to reach him in an emergency.

**He has not used his phone at work before, as we just got them. Everyone must lock their phones up. He's never recieved a personal call either, as I haven't had a need to call him at work.**

Your fiancee is an employee and is there to work. They are not allowed to take personal phone calls. They must have had a problem with him taking calls or making calls which is why they had to resort to that, either that or he is a spy and his phone ringing would cause his cover to be blown. ;)
Have your fiancee explain to his boss that you are pregnant and need a emergency contact number where if you call in with an emergency they will reach him. I'm sure they will help you with your situation.

Has he chatted away on company time before? Is he something like an armoured truck driver, where a heist or theft can be planned on the job by phone? There is a lot you did not say here. A lot of employers do not permit personal property while working (for example, retail). Use 9-1-1 for an emergency.

I suppose this is all down the the terms and conditions of the job your 'fiancee' is currently doing. If he signed a contract saying he's not allowed to use his personal mobile phone, then he must obey to it.
If you're not sure, ask his manager for a look at the terms and conditions/rules of the workplace, and if it doesn't state anything about the situation, then you could take the matter further.

Any work place makes exceptions for emergencies. (i.e. my water just broke!) The problem is, too many "workers" are too busy getting useless personal calls from their bf/gf, texting and talking on the cell phone to listen to my order and get it right. People like that ruin it for the ones that might actually need to get a phone call for a legit reason like yours! Unfortunately, this is always going to be the case in a fast food restaurant. Maybe your fiance should try to find a better job where he will get more respect from his superiors.

what does he do. Don't you have the main number to his work? Yes the guy can take the phones away. If the employees know phones aren't allowed why would they bring them to work. Also remember before there were cell phones? I got calls at work when they were important.

Obviously, if it has gotten to the point of locking his phone up and not allowing him to receive personal calls he must have severely abused his phone privilidges. Additionally, that says alot about the kind of employee he is. You are lucky that he even still has a job at that particular company.

Its legal if that is the office policy, however, it sounds like a very stupid policy.
We are not allowed to make or receive cell phone calls and the phone must be silent while we are in the office, however, we ARE allowed to have them because we DO go to break and lunch.
(His boss still lets them take their breaks and lunches, right?)

No it is not at all legal, however no doubt sometimes work suffers due to cell phones, we need to understand the requirement and emergency and make use accordingly.

No, they are not allowed to take his personal property. All they can do is ask that he not take personal calls or use his cell during work hours. If he doesn't comply, then they can fire him. Also, if you call his job and tell them that you are having an emergency with the baby, I'm sure they'll get him, unless they're psychos.

Make a phone call to any lawyer that handles job related issues and ask him this same question.......If he states that no employer can do this, then take that person for a "good ride" !!!!!
