Do children get to help choose their custodial parent in divorces?

Every state has different rules regarding whether a child can have a say with respect to what parent they want to live with. Most States use the best interest of the child standard when determining child custody. If a child is allowed to testify as to what they want, a Judge will generally only take their desires into consideration if they are of the age and maturity to make a decision about what is in their best interests. I would speak with an attorney in your state to determine what the specific laws are with respect to children's desires and child custody.

Only if a request for such is made to the judge to let the child decide. The judge usually takes the child into his chambers and asks them some questions and if he likes the answers, he usually lets the child decide. As long as there is no problem with the chosen parent, child is awarded a parent. Age has nothing to do with it, it goes by the ability to reason. I have heard of children as young as 4 being able to decide. But unless a special request is made, not all children in a divorce case get to chose.

At 14, the judge is likely to consider what the child would prefer.

Depends on your state...
However Child Services will look at both of you and if one of the parents in not a good guardian, even if the child choses them, they won't be able to stay with that person...

Different states different laws but some states do take into consideration what the child wants.You will need to find out what your state laws are.Maybe talk to a attorney.

at age 12 or 13 children have a choice ( well in Florida they do) guess it depends on the state

i am 14 and my parents were going threw a divorce AND i got to choose

Yes,and soon as there 14 they become a real teen and have a choice in life.

I heard at 11 years old they can choose, just check on it, may vary state to state.

Yes they do...I use to think it was age 14, But I have heard it is age 12.
